Case Significance
WUK v WUL and WUM [2024] SGFC 12 was a contested divorce decided in the Family Justice Courts (Divorce Suit No 3942 of 2022) by District Judge Cheryl Koh, with grounds of decision dated 15 February 2024 following hearings on 19 July, 5 and 6 September and 9 November 2023. The plaintiff wife sought dissolution of the marriage on the basis of the defendant husband's adultery and unreasonable behaviour, while the husband counterclaimed on the basis of the wife's unreasonable behaviour, relying on section 95(3)(a) and (b) of the Women's Charter (Cap 353). On 9 November 2023 the District Judge dissolved the marriage based on the wife's claim of the husband's adultery, dismissed the husband's counterclaim of the wife's unreasonable behaviour, and made no orders on the wife's claim of the husband's unreasonable behaviour. The husband appealed on 15 November 2023.
Summary
In contested divorce proceedings between a wife and husband married for about 21 years, the wife sought dissolution on the basis of the husband's adultery with a co-defendant and/or his unreasonable behaviour, while the husband counterclaimed on the basis of the wife's unreasonable behaviour. It was not disputed that the husband had emotionally withdrawn from the marriage, used a dating app, begun dating the co-defendant and initiated separation. The District Judge dissolved the marriage based on the wife's claim of the husband's adultery, dismissed the husband's counterclaim, and made no orders on the wife's claim of the husband's unreasonable behaviour.
