An Italian construction cooperative sought an interim anti-suit injunction against two Nepalese government entities to restrain them from pursuing proceedings in Nepal courts that breached a Singapore-seated arbitration agreement in a water supply infrastructure contract. The SICC granted the injunction, finding a prima facie case that the arbitration agreement was valid, the Nepalese proceedings were brought in breach of that agreement, and the second defendant was not entitled to sovereign immunity as the contract was a commercial transaction.
