Facts

Mr Png Chuck Kwang George @ Poon Chak Kwang and Mr Lee Choi Tong were neighbours in opposite flats at Block 279A Sengkang East Avenue. The victim relied on a walking stick. On 20 August 2023, at about 6.00pm, the victim argued with the accused's wife, Mdm Teo. At about 6.45pm the accused called the police. The victim was later found to have a scalp laceration, a bruised right forearm, an injured ring finger and a mildly displaced fracture of the right radial neck, which was managed conservatively.

The victim said the accused repeatedly hit his head with a rod, and that after he fell he raised his right arm to defend himself and was struck on it. His wife, Mdm Low, said she saw the accused repeatedly hitting his head as he lay on the ground. The accused admitted hitting the victim's head once with a wooden stick, the remnant of a curtain rod. He claimed he did so in defence of his wife and himself after the victim swung his walking stick at them, and that bicycles fell on the victim as he fell.

In Magistrate Arrest Case No 900518 of 2024, the accused claimed trial to voluntarily causing hurt which caused grievous hurt under s 323A of the Penal Code 1871. He has appealed against conviction and sentence.

Issues

  1. Whether the accused caused the fracture by hitting the victim's head and causing him to fall, or by hitting his right arm.
  2. Whether the accused intended to cause hurt.
  3. Whether the accused could rely on the right of private defence.
  4. What sentence was appropriate under the Ang Boon Han framework.

Holding

The court convicted the accused of the charge under s 323A of the Penal Code and sentenced him to 16 weeks' imprisonment. He is on bail pending his appeal.

Reasoning

On causation, the court found the victim credible. His one inconsistency, about whether his arm was struck, was explained by his focus on the blows to his head, and he consistently said he used his arm to block. A doctor said all the injuries were consistent with a stick like the exhibit, and Mdm Low's account corroborated him. The bicycle explanation was an afterthought, missing from the first police report and the early statements. Even if true, the fall was a direct result of the blow, so the chain of causation was unbroken.

On intention, the accused admitted striking the victim's head when he saw "an opening". The victim was dazed and fell, which showed considerable force, so he plainly intended hurt.

On private defence, the court found the frail victim posed no credible threat. The accused's repeated surprise that the victim could lift his stick showed he knew this, and arming himself before going out pointed to premeditation. His accounts of the threat were inconsistent, and Mdm Teo was found wholly unreliable. In any event he used more force than necessary and could have retreated into his flat to call the police, but chose to confront the victim.

On sentence, the court applied Ang Boon Han v Public Prosecutor [2024] 5 SLR 754. The injuries were broadly comparable to Arumugam Selvaraj v Public Prosecutor [2019] 5 SLR 881 and less serious than in Ang Boon Han, giving a starting point of 10 weeks. The injury was foreseeable given the victim's known frailty, so no adjustment was made. Six weeks were added for the victim's vulnerability and the repeated blows with a weapon. There was no remorse, as he downplayed the blows and did not call an ambulance. The newspaper report the defence relied on carried no weight.

From the judgment

“This was not a case where such assistance was unavailable to him — it was a case where he had chosen not to avail himself of it.”
