About the Magistrate Court

Part of the State Courts

The Magistrates' Courts are part of the State Courts, which also include the District Courts, the Coroners' Courts and three tribunals: the Small Claims Tribunals, the Community Disputes Resolution Tribunals and the Employment Claims Tribunals.

Some Magistrates' Courts, like some District Courts, sit as specialised courts, including the Criminal Mentions Court, the Community Criminal Court, the Traffic Court, the Night Courts and the Protection from Harassment Court.

What it hears

Civil claims not exceeding $60,000 in value.

Criminal cases where the maximum term of imprisonment does not exceed 5 years, or which are punishable with a fine only.

Appeals

Criminal and civil appeals from the Magistrates' Courts are heard by the General Division of the High Court.
